Individual Voluntary Arrangements (IVAs)
Key Features of an IVA
If you're in serious debt, and are struggling to make your repayments there are a number of benefits to an Individual Voluntary Arrangement, or IVA:
- You will make affordable repayments to your Individual Voluntary Arrangement, and payment levels will be agreed with your creditors in advance.
- IVA repayments will take place over a fixed period
- Once this fixed period of the IVA has been completed, any remainder of debt will be written off.
- During the term of your Individual Voluntary Arrangement, you will not have to deal with your creditors because Varden Nuttall will deal with them on your behalf.
- Once your IVA is accepted all further interest and charges on your debts will be frozen.
- Even creditors who vote against your IVA are still bound by its terms once the arrangement is accepted.
- IVAs allows debtors to avoid the stigma associated with bankruptcy.
- In the majority Individual Voluntary Arrangements, the subject’s career will be unaffected.
- You will enjoy the security of knowing your debt solution is legally binding.
- Unlike bankruptcy, you won't risk losing assets, such as your house.
In most cases, to qualify for an IVA you will need to meet the following criteria:
- Debts greater than £10,000
- At least 2 separate creditors with 3 lines of credit.
- Disposable income over £140 per month, assets to release or a 3rd party to contribute into the arrangement.
- Applicants must be able to show they have allowed for reasonable necessary living expenses such food, utilities, travel costs, council tax etc. Creditors are constantly criticising those who state too much or too little for food. Some IVA cases fail because applicants spend too much on car hire purchase payments.
- The insolvency practitioner must make a positive 'Nominees Report' which portrays a professional opinion as to whether the Individual Voluntary Arrangement - IVA is a realistic offer. He or she will decide whether the applicant is going be reliable and thus ensure the IVA has the best chance of success.
If all of these criteria are met, the IVA team will explore all available debt solutions and only recommend an IVA where appropriate to your financial situation.
If any of these criteria cannot be met, the company is unlikely to recommend an Individual Voluntary Arrangement. In these circumstances the company may recommend an alternative solution for the debtor which would typically be a debt management plan or even bankruptcy, although there are other alternatives available.
